1. Acceptance of Terms

By downloading, accessing, or using Scrunchie ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Scrunchie is operated by CODETIVE Pawel Boguta ("we," "us," or "our").

2. Description of Service

Scrunchie is a mobile application designed to help users track and improve their curly hair care routine. The App provides features including daily curl analysis using artificial intelligence, hair diary tracking, personalized recommendations, educational content, and product scanning.

3. Eligibility

You must be at least 13 years of age to use the App. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

4. Account Registration

To access certain features, you may need to create an account. You agree to provide accurate, current, and complete information during registration. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

5. Subscriptions and Payments

Scrunchie offers subscription-based access to premium features. By subscribing, you agree to pay the applicable fees as displayed in the App.

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions through your Apple App Store account settings.

All payments are processed by Apple through the App Store. Refunds are subject to Apple's refund policies and must be requested directly through Apple.

6. Free Trials

We may offer free trial periods for premium subscriptions. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription.

7. AI-Generated Content

Scrunchie uses artificial intelligence to analyze photos and provide personalized recommendations. AI-generated content is for informational purposes only and should not be considered professional advice. Results may vary and are not guaranteed.

8. User Content

You retain ownership of any photos or content you submit through the App ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and analyze such content solely to provide and improve the App's services.

9. Prohibited Conduct

You agree not to: (a) use the App for any unlawful purpose; (b) attempt to reverse engineer the App; (c) interfere with the App's servers or networks; (d) upload malicious code; (e) impersonate any person or entity; (f) violate any applicable laws.

10. Intellectual Property

The App, including its design, features, content, and functionality, is owned by CODETIVE Pawel Boguta and is protected by intellectual property laws.

11. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

SCRUNCHIE IS NOT A SUBSTITUTE FOR PROFESSIONAL HAIR CARE, DERMATOLOGICAL, OR MEDICAL ADVICE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CODETIVE PAWEL BOGUTA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify and hold harmless CODETIVE Pawel Boguta from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

15. Modifications to Terms

We may update these Terms from time to time. Your continued use of the App after such changes constitutes acceptance of the updated Terms.

16. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms or for any other reason at our discretion.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland.
